1. Introduction

Welcome to ZapSettle, a mobile application operated by MiTara Enterprises LLC (“we,” “our,” or “us”). This Privacy Policy and Terms of Use (collectively, the “Agreement”) governs your access to and use of the ZapSettle mobile application (the “App”) and describes how we collect, use, share, and protect your personal information. By downloading, accessing, or using the App, you agree to the terms set forth in this Agreement. If you do not agree to all terms, do not use the App.

This Agreement is drafted to comply with applicable laws including the California Consumer Privacy Act (CCPA), California Online Privacy Protection Act (CalOPPA), and other relevant U.S. laws. It reflects best practices consistent with those advised by leading legal counsel, including Silicon Valley law firms such as Orrick, Herrington & Sutcliffe LLP.

2. Information We Collect

We collect the following categories of information:

• Mailing Address

• Phone Number

• Date of Birth

• Demographic Data (e.g., gender, ethnicity, preferences)

Automatically Collected Information

• Device Information (e.g., model, operating system, device ID)

• Network Information (e.g., IP address, mobile carrier, connection type)

• Geolocation Data (precise or approximate location based on GPS or IP)

This data may be collected directly by us or by authorized third-party service providers integrated into the App.

3. Purpose of Collection

Your information is collected and used for the following business and commercial purposes:

• Account creation and user verification

• Identification of eligible legal claims

• Pre-filling and submission of class action claim forms

• Communication regarding claims and payments

• Operation, personalization, and improvement of the App

• Marketing and advertising by our partners and affiliates

• Legal compliance and enforcement of our rights

4. Data Sharing and Sale

We may share or sell non-sensitive personal information (including name, address, demographic data, and email) to third-party partner marketing firms, advertisers, and data platforms for business and commercial purposes, as permitted by California and U.S. law.

We do not sell sensitive financial data (e.g., bank account or payout details).

You may opt-out of the sale of your personal data by submitting a request through the “Account Management” tab or emailing privacy@zapsettle.com.

5. Data Storage and Protection

We use industry-standard security measures including encryption-at-rest, encryption-in-transit, access controls, and intrusion detection to safeguard your personal data. User data is hosted on secure infrastructure provided by third-party cloud services compliant with SOC 2, ISO 27001, and PCI-DSS standards.

Despite these efforts, we cannot guarantee the absolute security of any information transmitted via the internet or stored electronically.

6. Your Rights and Controls

You have the following rights regarding your personal data:

• Access: View and download your personal data through the “Account Management” tab.

• Deletion: Request permanent deletion of your account and personal data from our systems.

• Data Portability: Export your data in a commonly used format.

• Opt-Out: Opt out of data sale and marketing communications.

We respond to all rights requests in accordance with applicable state and federal laws within the legally required timeframe.

7. Conditions of Use

By using the App, you agree to:

• Provide true, accurate, and current information

• Use the App solely for lawful purposes

• Not interfere with the operation, security, or functionality of the App

• Not exploit, reverse-engineer, or scrape our systems

Violation of these terms may result in suspension or termination of your access to the App.

8. Children’s Privacy

The App is intended only for users aged 18 and older. We do not knowingly collect personal data from children under the age of 18. If we discover such data, it will be promptly deleted.

9. Modifications to This Policy

We may revise this Agreement at our sole discretion. Updates will be posted in-app and/or emailed to registered users. Your continued use of the App following notice of updates constitutes acceptance of the revised terms.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed under the laws of the State of California, without regard to its conflict of laws principles. Any legal proceedings related to this Agreement shall be initiated in the state or federal courts located in Sonoma County, California.
